Florida Entertainment Industry Sales Tax Exemption

Pursuant to s. 288.0071 F. S., effective July 1, 2023, prior to the approval of any Florida economic incentive application, a signed and notarized affidavit attesting the applicant is not a foreign entity of concern must be provided to FloridaCommerce.  Please find an affidavit that may be used here:  288.0071 F. FloridaCommerce offers a point-of-sale Sales Tax Exemption to qualified production companies producing content in Florida.

Who Qualifies?

Any qualified production company producing films, television series, commercials, music videos, or sound recordings in the state may be eligible for a sales-and-use tax exemption on certain production-related purchases in Florida. Still photography is not a qualified production activity.

How do I apply?

Helpful Hints
  • Browser: Use Chrome for the best application experience. Refresh and clear your cache.
  • If your company is based in Florida: You may be eligible for a 12-month or 90-day certificate. Make sure that your business is Active on Sunbiz.org. If your address or FEIN has changed since your last certificate, please update your Sunbiz registration before renewing your certificate.
  • If your company is based out of state: You may be eligible for a 90-day certificate. Verify that your company is registered to do business in the state in which it does principal business. You can find this information on your state’s Secretary of State or Corporations website.
  • Recovering your session: If your session has timed out and you would like to recover the information you have already entered on the application, you can recover your session. When recovering a session, if prompted for a new user ID, you may enter your current user ID.
  • Filling out your application: Make sure to complete the full application including listing at least one of your Florida project’s names and dates. You will also need to provide your total estimated financials for the full term of the certificate (either 90 days or 12 months). Please make sure to sign your name at the end of the application and hit “submit” prior to exiting!
  • What happens after approval: You will receive a confirmation email from the Department of Revenue. Once an application is complete, the certificate will be issued in 2-3 business days and a PDF copy will be emailed to you from our office. The Department of Revenue will mail the original to the address provided on the application.
